7.Immigrant visa applications - starting at 8:00pm EDT on June 29, 2017, IV applicants presenting passports from one of the six designated countries will be interviewed and adjudicated according to the following procedures:

1. 1. Officers should first determine whether the applicant is eligible for an IV without considering the EO.
      
      
      1. If no, the IV application should be refused according to usual refusal procedures.
      
      
   2. If eligible for an IV, during the interview the officer
      
   3. should determine whether the applicant is exempt from the EO.
      
      
      1. If exempt, the IV should be issued.
      
      
   4. If the applicant is not exempt, the officer should determine whether the applicant qualifies for a waiver.
      
      
      1. If the applicant qualifies for a waiver, the IV should be issued.
      
      
   5. Applicants who are not exempt from the EO and who do not qualify for a waiver should be refused an IV.

authorize the issuance of a visa on a case-by

-case basis when the applicant
demonstrates to the officer’s satisfaction that the following three criteria
are all met:

a.) Denying entry during the 90-day suspension would cause undue hardship;

b.) His or her entry would not pose a threat to national security; and

c.) His or her entry would be in the national interest.

میخواستم سوال کنم که منظور شما از این حرف تاثیر فرمان اجرایی روی این نوع کیسها در مرحله IVP هست؟ اگر اینطور هست، آیا مرجعی برای این نتیجه گیری دارید؟

شما چه تاریخی برای مصاحبه دعوت شدید(سال 2017 بوده یا پیشتر از اون)؟ مصاحبتون کجا بود؟ امکان داره کمی در مورد سوالات و اینکه چقدر شغل فعلی شما با زمینه رشته ی تخصصیتون متفاوت بوده یا نه و اینکه اساسا آفیسر چگونه مصاحبه رو پیش می بره توضیح بدید ؟

ما حدود یک و نیم ماه پیش برای این هفته دعوت به مصاحبه شدیم که با توجه به وضعیت اخیر تصمیم گرفتیم که مصاحبه را نریم تا بعد ببینیم چی پیش می آد

من هم با توجه به وضع کنونی شاید تصمصم بگیرم (مجبور بشم) از وکیل کمک بگیرم
در مورد زمان دعوت به مصاحبه، هر چند وکیل معتقده بین 8 الی 12 ماه، اما من 2 نفر از کسانی رو که می شناسم و البته EB1 بودند، بین 3 تا 5 ماه بعد از APPROVAL اشون دعوت به مصاحبه شدند.

به نظر شما گرفتن وکیل بعد از انجام مصاحبه (IVP) هم میتونه مفید باشه؟ اون موقع که دیگه به نظر میاد کار کلا در سفارت انجام میشه، ما هم که فعلا دستمون از اونور کوتاهه تا بشه پیگیری دیگه ای کرد.

من احتمالا به اين نتيجه مي رسم كه برلي ivp. وكيل بگيرم و اينكه تا پايان اين ٩٠ روز، فرمان اجرايي روي كليه كيسهاي ivpاثر داره

چيزي كه من خوندم نوشته بودند كه self petitioned مربوط به كيس هاي eb1-a هست

self petitioned هم خانواده ویزاهای eb1 و همeb2-niw رو شامل میشه و درست هم هست چرا که کلیه کیس های niw در مفهوم و ذات نیاز به job offer و یا ساپورت شرکت یا کارفرمایی ندارند و این یعنی self petitioned. اینکه برخی از case های niw در داخل خود امریکا از طریق شرکتی که در اون مشغول به کار هستند رو کاری ندارم چرا که اونها باید پروسه ی i-485 رو طی کنند و احتمالا باید تو اون مرحله نشون بدند که کار دارند ... (البته اطلاعات من در خصوص i-485 بسیار اندکه).

According to Section 3(c) of the EO, a waiver may be appropriate under the followingcircumstance:
(i) the foreign national has previously been admitted to the United States for a4continuous period of work, study, or other long-term activity​, is outside the UnitedStates on the effective date of this order, seeks to reenter the United States to resumethat activity​, and the denial of reentry during the suspension period would impair thatactivity;
(ii) the foreign national has previously established significant contacts with theUnited States​ but is outside the United States on the effective date of this order for work,study, or other lawful activity;
(iii) the foreign national seeks to enter the United States for significant business orprofessional obligations​ and the denial of entry during the suspension period wouldimpair those obligations;
(iv) the foreign national seeks to enter the United States to visit or reside with aclose family member (e.g., a spouse, child, or parent) who is a United States citizen,lawful permanent resident, or alien lawfully admitted on a valid nonimmigrant visa​,and the denial of entry during the suspension period would cause undue hardship​;
(v)the foreign national is an infant, a young child or adoptee, an individual needingurgent medical care, or someone whose entry is otherwise justified by the specialcircumstances of the case;(vi) the foreign national has been employed by, or on behalf of, the United StatesGovernment (or is an eligible dependent of such an employee) and the employee candocument that he or she has provided faithful and valuable service to the United StatesGovernment;
(vii) the foreign national is traveling for purposes related to an international organizationdesignated under the International Organizations Immunities Act (IOIA), 22 U.S.C. 288et seq., traveling for purposes of conducting meetings or business with the United StatesGovernment, or traveling to conduct business on behalf of an international organizationnot designated under the IOIA;
(viii) the foreign national is a landed Canadian immigrant​ who applies for a visa at alocation within Canada; or
(ix) the foreign national is traveling as a United States Government-sponsoredexchange visitor​.
