    سلام
    دوستان عزیز
    سوالی که در این تاپیک دارم ساده است اینه که
    -آیا شهروندان ایرانی میتوانند تابعیت ژاپن و پاسپورت ژاپنی رو کسب کنند؟
    من مدتی در این مورد تحقیق کردم و به مطالب بعضا متناقضی بر خوردم.
    با یک سرچ در سایت های فارسی و یا خارجی متوجه میشیم که اکثرشون نوشتن که ژاپن تابعیت دوگانه رو قبول نداره و برای کسب تابعیت ژاپن باید تابعیت ایران رو لغو کرد.
    و از طرفی همه ما میدونیم که ترک تابعیت برای ما ایرانیها بسیار دشوار و تقریبا غیرممکن هست.
    در کنار اینها مصاحبه سفیر اسبق ایران در ژاپن هم در سال 88 نکات جالبی داره
    در بخشی از این مصاحبه سفیر ایران میگه

    ژاپن همچون ايران تابعيت دوگانه را به رسميت نمي‌شناسد، ‌چنانچه يك تبعه خارجي قصد اخذ تابعيت ژاپن را داشته باشد، ابتدا بايستي تابعيت قبلي خود را ترك كرده و سند خروج از تابعيتش را جهت اخذ تابعيت ژاپن به مقامات ژاپني ارائه كند تا درخواست وي مورد بررسي قرار گيرد و بالطبع اتباع ايراني نيز از اين قانون مستثني نيستند و در صورت درخواست و دارا بودن شرايط ملزم به طي مراحل قانوني هستند.
    البته در بخش دیگری از مصاحبه هم سفیر ایران به نکته جالبی اشاره میکنه

    كنسول سفارت ايران در توكيو به ترك تابعيت 80 تبعه ايراني و كسب تابعيت ژاپني اشاره كرد و در عين حال يادآور شد كه براساس ماده 990 قانون مدني جمهوري اسلامي ايران، كساني كه تابعيت ايراني خود را ترك و تابعيت ديگري كسب كرده‌اند مي‌توانند مجدداً درخواست بازگشت به تابعيت ايراني خود را به مقامات مربوطه ارائه كنند.
    جالب هست از این نظر که چگونه این 80 نفر توانسته اند تابعیت ایرانی خود را ترک کنند؟؟!! و نکته جالب دیگر اینکه یکی از ضعف های قانون ژاپن این هست که زمانی که شما تابعیت این کشور را کسب میکنید یا دارا هستید و تابعیت کشور دیگری را کسب میکنید دو سال وقت دارید تا به دولت ژاپن اطلاع دهید که تابعیت اکتسابی خود را لغو کرده اید یا قصد دارید تابعیت ژاپنی خود را لغو کنید.
    و ژاپنی های زیادی را میبینید که دو ملیتی هستند یعنی اول ملیت ژاپنی را یا از طریق خون یا از طریق naturalisation کسب کرده اند که از راه دوم naturalisation تابعیت قبلی خود را برای کسب تابعیت ژاپنی لغو کرده اند و سپس به نحوی بدون اینکه دولت ژاپن متوجه موضوع شود درخواست کسب تابعیت قبلی را میدهند البته در صورتی که قانون آن کشور اجازه دهد به طور مثال برای این 80 نفر که در مصاحبه سفیر گفته شده اند این امکان را وجود دارد.

    از سوال اصلی موضوع خارج نشویم این که آیا ایرانی ها میتوانند تابعیت ژاپنی را کسب کنند یا نه؟؟

    اما قوانین ژاپن برای کسب تابعیت چه میگویند
    روشهای گوناگونی وجود دارد ازدواج و ... که ما فقط naturalisation رو بحث میکنیم
    شروط naturalisation چیست؟

    The Minister of Justice shall not permit the naturalization of an alien unless he or she fulfills all of the following conditions:
    (1) that he or she has domiciled in Japan for five years or more consecutively;
    (2) that he or she is twenty years of age or more and of full capacity to act according to the law of his or her home country;
    (3) that he or she is of upright conduct;
    (4) that he or she is able to secure a livelihood by one's own property or ability, or those of one's spouse or other relatives with whom one lives on common living expenses;
    (5) that he or she has no nationality, or the acquisition of Japanese nationality will result in the loss of foreign nationality;
    (6) that he or she has never plotted or advocated, or formed or belonged to a political party or other organization which has plotted or advocated the overthrow of the Constitution of Japan or the Government existing thereunder, since the enforcement of the Constitution of Japan.

    حالا به ترتیب هر کدوم از اینها رو تشریح میکنیم
    1.اقامت پنج ساله در ژاپن(نکته جالب هر نوع اقامتی هست یعنی دانشجویی،کاری،و... حساب میشه البته توریستی حساب نمیشه)
    2.حداقل 22 سال سن و تبعیت از قوانین
    3.حسن نیت
    4.توانایی اقتصادی کافی جهت گذران زندگی در زمان تقاضا
    5.در ادامه توضیح میدم(دقیقا مشکل ایرانی ها همین جاست)
    6.عضو هیچ گروه سیاسی نباشه

    برای شرط 5 که گفتم توضیح میدم در ادامه قانون یک تبصره وجود داره

    2. When an alien is, regardless of his or her intention, unable to deprive himself or herself of his or her current nationality, the Minister of Justice may permit the naturalization of the alien, notwithstanding that the alien does not fulfill the conditions set forth in item (5) of the preceding paragraph, if the Minister of Justice finds exceptional circumstances in his or her family relationship with a Japanese national, or other circumstances.

    حالا این چی میگه؟؟

    این میگه که در صورتی که نتوانید تابعیت خود را لغو کنید بدون توجه به قصد فرد وزارت دادگستری ژاپن در صورت پیدا کردن شرایط خاصی در فرد میتونه با درخواستش موافقت کنه.

    حالا باز معلوم نشد که میشه یا نه؟؟

The proposal also calls for foreigners to be allowed to obtain Japanese nationality without losing their original citizenship.

    There are still some ways in which a person may have dual citizenship of Japan and another country, including:

    They acquire multiple citizenships at birth, such as being born to a non-Japanese citizen parent and acquiring that parent's citizenship as a result of that country's laws or by being born in a jus soli country. However, they must choose one citizenship/nationality before the age of 22 or within two years if the second citizenship is acquired after the
    age of 20, or they may lose their Japanese nationality
    though this is not enforced.که ایران هم جزو jus soli country هست.

    که آیا ایرانی ها میتوانند تابعیت ژاپن رو کسب کنند یا خیر؟؟

    (توضیح :گرداننده این سایت یک آمریکایی هست که خودش تابعیت آمریکاییش رو ترک کرده و تابعیت ژاپنی کسب کرده.)

    Do some naturalized Japanese become legal dual nationals?

    Yes, depending on your nationality, you may have to keep your former nationality because the other country will not allow you to get rid of your non-Japanese nationality.

    In principle, as part of the Japanese naturalization law, you need to get rid of all your other nationalities either before you receive your Japanese nationality (ex. United Kingdom, Canada) or within two years after receiving your Japanese nationality (ex. United States, New Zealand). Whether you do it before or afterwards is not your choice. It depends on the whether the nationality laws of other countries allow their citizens to lose their citizenship without having already acquired another. In other words, do they allow brief (or permanent) periods of statelessness?

    The reason some countries do not allow their citizens to become stateless is usually because they are following the United Nations 1961 Convention on the Reduction of Statelessness, which stipulates that loss/renunciation should be conditional upon the prior possession or assurance of acquiring another nationality.

    Even Japan, which guarantees the right of its nationals to lose their Japanese nationality in their Constitution (Article 22), will not let one do so until they have first acquired another nationality.
    2) Freedom of all persons to move to a foreign country and to divest themselves of their nationality shall be inviolate.
    However, there are some countries in the world where losing your nationality is either completely impossible or may be denied due to reasons unrelated to the possession of another passport.

    Countries that don't allow one to lose their nationality †:

    • Bolivia
    • Costa Rica

    Countries that don't allow one to lose their nationality if they're natural-born (not naturalized)†‡:

    • Dominican Republic
    • Ecuador
    • Guatemala
    • Honduras
    • Nicaragua
    • Nigeria
    • Uruguay

    Countries where one's attempts to lose one's citizenship may be denied for reasons other than statelessness and/or is extremely difficult (for example, requiring an in-person appearance in that country before a judge):

    • Afghanistan
    • Algeria
    • Angola
    • Argentina
    • Cuba
    • Eritrea *
    • Iran
    • Iraq
    • Lebanon
    • Morocco
    • Nigeria
    • Syria
    • Thailand
    • Tunisia

    In the above countries, Japan will allow those who naturalize to submit a 国籍選択届kokuseki sentaku todoke (Choice of Nationality Declaration) instead of renouncing or relinquishing one's impossible-to-lose nationality.

    Note that any Japanese national can complete this form at their local ward office or city hall (区役所/市役所kuyakusho/shiyakusho) as long as they have additional nationalities. Doing this creates an entry on your 戸籍koseki (family register) labeled 国籍選択kokuseki sentaku (nationality choice). However, just because you can do it does not mean a naturalized American or New Zealander etc can choose to this in lieu of properly divesting their nationalities and reporting it to Japan (which creates a separate entry in the family register: 外国国籍喪失gaikoku kokuseki sōshitsu). Thus, a former American can have two (or more!) entries in their family register: an initial Nationality Choice record followed by a Loss of Foreign Nationality record. Both for the same country. If you are naturalizing and your original nationality is not one that has been explicitly designated by your case officer as being one from which loss of nationality is not possible, you need to either have your former nationality, listed in the 帰化kika (naturalization) personal detail records (身分事項mibun jikō) under 帰化の際の国籍kika no sai no kokuseki (nationality at time of naturalization) as 無国籍mukokuseki (stateless) — as will be the case for those from the United Kingdom — or you need a 外国国籍喪失gaikoku kokuseki sōshitsu (loss of foreign nationality) record in your 戸籍koseki (family register) dated within two (2) years of the date of your naturalization. Until you do this, you haven't legally met condition #5 in the Japan Nationality Law considering nationalization (Article 5):
    (5) that he or she has no nationality, or the acquisition of Japanese nationality will result in the loss of foreign nationality;
    2. When an alien is, regardless of his or her intention, unable to deprive himself or herself of his or her current nationality, the Minister of Justice may permit the naturalization of the alien, notwithstanding that the alien does not fulfill the conditions set forth in item (5) of the preceding paragraph, if the Minister of Justice finds exceptional circumstances in his or her family relationship with a Japanese national, or other circumstances.
    There is a theoretical (never seen put into reality yet) worry that one's naturalization could be annulled (administrative denaturalization), although due to the tiny numbers** of naturalized citizens who abuse this, most likely, if they notice, they will probably first call and ask for an explanation and/or remind you and work with you and your schedule before they did something so drastic.

    Another thing to note is that fulfilling your tax obligations as defined by law is not considered to be "unable to lose one's nationality", allowing you to just do the Choice of Nationality declaration within Japan without formally losing your citizenship. For example, extremely wealthy Americans may be asked to pay what is colloquially known as an "exit tax" after they relinquish or renounce their U.S. citizenship. Because the U.S. doesn't actually stop these rich Americans from losing their U.S. nationality, and you are not assessed this "exit tax" until after you lose your U.S. nationality (you file a 8854 form with your file 1040 after losing your U.S. nationality), rich Americans are not considered by the Japanese government as being "unable" to meet the requirement of Japanese naturalization, which is getting rid of your former nationality.

    Interestingly, not allowing a person to divest themselves of their nationality is considered to not be in the spirit of The Universal Declaration of Human Rights, Article 15:
    (2) No one shall be arbitrarily deprived of his nationality nor denied the right to change his nationality.

    † Many "new world" countries (the nation-states in North and South America) tend to be more permissive in giving out natural-born citizenship (many are jus soli, or right-to-nationality by being born on the national soil) and also less permissive about letting you get rid of that nationality.
    ‡ Many "new world" countries have different classes of non-foreign people: nationals and citizens. All citizens are nationals, but nationals are not always citizens. Generally, those who naturalize get less rights than those who are natural-born. For example, naturalized people cannot be President in either the United States or Mexico. In Mexico, there are many government jobs that naturalized citizens are not permitted to hold. On the other hand, naturalized Mexicans may divest themselves of their nationality. Japan makes no distinction between nationals and citizens; a naturalized person has all the legal rights and privileges that a natural-born citizen has, including the ability to become the Prime Minister ( 総理大臣sōri daijin).
    * Eritrea is also the only country other than the United States that taxes based on citizenship in all situations. In other words, Eritreans, like Americans, must file and/or pay their taxes regardless of where they work or live in the world depending on their revenue and income status. Unlike Americans, they cannot divest themselves of their nationality.
    ** The vast majority of people who naturalize to Japanese come from countries (China and Korea) where they lose their original citizenships just prior to receiving their official 帰化者の身分証明書kikasha no shōmeisho (proof of identity of naturalized citizen) or just after automatically (because their own country doesn't recognize dual nationality), so it's not possible for them to become dual national and hide it even if they intended to flaunt the law.

    در نهایت اینکه اگر توضیحات پست آخر رو مد نظر قرار بدیم ایرانی ها هم میتوانند با حفظ ملیت تابعیت ژاپن رو کسب کنند.
    حالا میخواستم بدونم کسی از این موضوع استفاده کرده و تونسته تابعیت ژاپن رو کسب کنه؟؟

    من در اینمورد خیلی تحقیق نکردم. بیشتر بر اساس شنیده ها میگم.

    دولت ژاپن تابعیت دوگانه را قبول ندارد. اگر میخواهید تابعیت ژاپن را بگیرید، باید تابعیت ایران را لغو کنید.

    امکان گرفتن تابعیت ژاپن برای ایرانیان هست و تعدادی از ایرانیان ساکن ژاپن، تابعیت ژاپن را گرفته اند.

    امکان ترک تابعیت ایران هست، البته زمانبر است.

    من شنیده ام، تعدادی از ایرانیانی که تابعیت ژاپن را گرفته اند، بعداً با ابراز ندامت تابعیت ایران را پس گرفته اند. البته من نمیدانم احتمال موفقیت چقدر هست. بهرحال اینکار هم مانند دیگر کارهای اداری در ایران، نیازمند تلاش زیاد و پیدا کردن چند دوست و آشنا در وزارت امور خارجه هست. ضمناً دولت ژاپن هم نباید بفهمد.

    امکان گرفتن تابعیت ژاپن از طریق تولد در ژاپن هم هست، و همینطور گرفتن تابعیت کشور محل تولد پدر و مادر (پس دو تابعیتی میشود). فردی را میشناسم که در ژاپن متولد شده و تابعیت ژاپن دارد. و الان در ایران زندگی میکند و تابعیت ایران هم دارد (پدر ایرانی و مادر ژاپنی).

    به هر حال من در این مورد تحقیق کردم و در نهایت به این جمع بندی رسیدم و این برداشت و چکیده تحقیقات خودمه که در پایین توضیح میدم
    امیدوارم به درد دوستان بخوره
    برای کسب شهروندی ژاپن از راه naturalisation در زمان در خواست کسب تابعیت این کشور شش شرط هست که
    1.اقامت پنج ساله در ژاپن(هر نوع اقامتی دانشجویی،کاری و .. به جز توریستی جزو پنج سال محاسبه میشود البته به شرطی که در هر سال 80 درصد اون سال رو در کشور ژاپن اقامت داشت محاسبه میگردد)
    2.حداقل 20 سال سن و تبعیت از قوانین
    3.حسن نیت
    4.توانایی کافی و مالی از نظر اقتصادی جهت گذران زندگی
    5.عدم عضویت و وابستگی به گروه های سیاسی
    6.بدون ملیت و یا در صورت کسب ملیت ژاپنی ملیت اولیه فرد براساس قوانین آن کشور لغو گردد
    برای ما ایرانیان برآورده کردن شروط 1 تا 5 مشکلی ندارد.برای شرط شش نیز طبق قوانین کسب شهروندی ژاپن تبصره ای گذاشته شده که اگر به دولت ژاپن ثابت کنید نمیتوانید تابعیت خود را لغو کنید با در خواستتان موافقت میکنند.
    پس یک فرد ایرانی بعد از برآورده کردن شروط 1 تا 5 قوانین شهروندی ژاپن میبایست درخواست ترک تابعیت خود را به سفارت ایران تحویل دهد که دو حالت پیش می آید یا دولت ایران با در خواست فرد موافقت میکند یا مخالفت
    که بهترین کار برای درخواست دهنده مخالفت با درخواست وی است که بعد از اثبات این مخالفت به دولت ژاپن با استفاده از تبصره موجود در قوانین شهروندی ژاپن به طور قانونی تابعیت دو گانه ژاپنی-ایرانی داشته باشید.
    در صورتی که دولت ایران با درخواستتان موافقت کند نیز با برآورده کردن مستقیم و بدون قید و شرط تمامی شروط شهروندی ژاپن شما شهروندی ژاپن را کسب میکنید و دیگر شهروند ایران نیستید و برای ورود به ایران با شما مانند یک خارجی رفتار میشود و حق داشتن هیچ نوع مال و اموالی در داخل ایران ندارید البته بعد از کسب شهروندی ژاپن شما میتوانید در خواست بازگشت به تابعیت را به دولت ایران بدهید که روند زیاد پیچیده ای ندارد و معمولا مورد قبول واقع میگردد و شما میتوانید مجددا شهروندی ایران را نیز کسب کنید و از تمام حقوق شهروندی استفاده کنید البته همواره باید این شهروندی را از دولت ژاپن مخفی کنید چرا که دولت ژاپن شما را به عنوان شهروند تنها کشور ژاپن میشناسد و درصورت فهمیدن موضوع شهروندی ژاپن را از شما سلب میکند.البته معمولا دولت ژاپن متوجه این موضوع نمیشود مگر این که بخواهید به درجات بالای سیاسی یا قهرمان ورزشی تبدیل شوید که در آن صورت بالطبع دولت ژاپن متوجه موضوع میشود.
    چند نکته ای که در مدت تحقیقم در مورد این موضوع برخوردم یکی این هست که در قوانین هیچ حرفی از تسلط به زبان ژاپنی زده نشده یعنی هیچ شرطی مبنی بر بلد بودن این زبان نیست ولی در زمان در خواست از شما میخواهند تا یک سری توضیحات مثل دلیل در خواست(Reason for application) و ... را در مقابلofficer پر کنید که به خود به خود نیاز به دانستن این زبان میباشد.
    هر نوع سابقه تخلف و جرم حتی جرایم رانندگی بر درخواست شهروندی تاثیرگذار است و ممکن است با درخواست مخالفت شود.
