سلام دوستان من جز متقاضيان فدرال 29 شغله 1000 نفر هستم كه به عنوان اولين نفر از فدراليها كه از ويزا افيس ورشو به علت نداشتن سابقه بيمه تامين اجتماعي ريجكت شدم، صلاح ديدم نامه ريجكتيم رو اينجا بگذارم شايد درسي باشد از بيعدالتي ورشو براي ايندگان كه با دقت بيشتري مدارك تهيه كنند. نه اينكه شما رو بترسونم اما سابقه كار من از 3 شركت معتبر بود از جمله بيمه دانا و بيمه پارسيان و يك شركت خصوصي كه شماره ثبت و سايت داشت. همه گواهي سوابق كاريم روي سربرگ رسمي شركت با مهر و امضا همراه با ادرس و تلفن بود. در تمام اونها جزييات كاريم كاملا قيد شده بود .7 ماه پس از اقدام از من سابقه بيمه خواسته شد كه چون در محل كارم بيمه نبودم براي تمام اين سالها فيش ساليانه به همراه قرارداد كاري مدت معين داده بودم كه همه جزييات ساعت كاري هم توش بود. و نامه اي توضيحي دادم از وضعيت بيمه در ايران كه خيليها در ايران بيمه نيستند و غيره..
اما بعد از اندي نامه ريجكت گرفتم در ضمن وكيل هم داشتم كه جز مشاورين تاييد شده از طرف كانادا بود.( در توضيح براي بعضي از دوستان كه شايد سوال برايشان پيش ايد من مدارك تحصيلي ام با سابقه كارم متفاوت بود اما تاييده داشتم كه دوره 80 ساعته طبق قانون مربوط به شغلم در شركت گذرانده بودم )

Dear…
I have now completed the assessment of your application for a permanent resident visa as a skilled worker. I have determined that you do not meet the requirements for immigration to Canada.
Subsection 75 (2) of the Immigration and Refugee Protection Regulation states that a foreign national is a skilled worker if:
(a) within 10 years preceding the date of their application for a permanent resident visa, they have at least one year of continuous full-time (37.5 hours/week) employment experience, as described in subsection 80 (7), or the equivalent in continuous part-time employment in one or more occupations, other than a restricted occupation, that are listed in Skill Type 0 Management Occupation or Skill level A or B of the National Occupational Classification matrix;
(b) during that period of employment they performed the actions described in the lead statement for the occupation as set out in the occupational descriptions of the National Occupational; and
(c) during that period of employment they performed a substantial number of the main duties of the occupation as set out in the occupational descriptions of the National Occupational Classification, including all of the essential duties.
In my letter of 17 November 2011 you were requested to submit certificates from the state or private pension organization in order to confirm payment of social insurance contributions for the period of your employment. To date I have not received this document. I have reviewed the documents submitted by you on 20 December 2011 and all the information available on file. I am not satisfied as to the genuineness of any of your work experience. Consequently, I am not satisfied that you meet first part of the requirements mention above.
Subsection 75 (3) states that if a foreign national fails to meet this requirements, the application shall be refused and no further assessment is required. I am not satisfied that you meet these requirements.
Subsection 11 (1) of the Act states that a foreign national must, before entering Canada,
Apply to an officer for a visa or for any other document required by the regulations. The visa or document maybe issued if, following an examination, the officer is satisfied that the foreign national is not inadmissible and meets the requirements of this Act. Subsection 2 (2) that unless otherwise indicated, references in the Act to “this Act” included regulation made under it.
Following an examination of your application, I am not satisfied that you meet the requirements of the Act and the regulations for the reasons explained above. I am therefore refusing your application.
