what laws and regulations apply to foreign workers?
Special regulations for foreign graduates from German universities went into effect in 2007. What this means in concrete terms is that, because you have graduated from a German university, you can more easily obtain a residence permit with the right to engage in gainful employment.
After concluding your studies in Germany, you can apply for a one-year residence permit for the purpose of looking for a job. To be eligible, you have to demonstrate that you can cover your costs of living and that you are serious about seeking employment. While looking for a permanent position, you are allowed to continue working part-time – but only to the extent allowed for students without special permission.
If you succeed in finding a job within one year, you are allowed to stay in Germany. You can have your residence permit converted to one for the purpose of engaging in gainful employment.
There is one stipulation, however – your new position must correspond to the subject you studied at university. In other words, you have to find a job that has something to do with what you’ve actually studied. Furthermore, you may not be overqualified for the position. For example, in the first case, a graduate who studied Medicine is not suited for a job as a computer programmer. In the second case, a graduate who studied Art History is overqualified to take a job waiting tables at a museum café.
After five years of working in a qualified position, you are allowed to maintain your residence status indefinitely. After three more years at
the latest, you have the right to apply for German citizenship and with it, a German passport.
