I am writing in response to your complaint against Associate Professor - in the School of Engineering and Physical Sciences at James Cook University (JCU).

I understand that A/Prof.- communicated with you extensively about the prospect of your studying for a PhD at JCU. Towards the end of your application, however, A/Prof.- was made aware of a recent autonomous sanction put in place by the Australian Government against the Iranian Government, which has significant impacts on the recruitment of students from Iran. At that point, A/Prof. - e-mailed you to advise a policy review and delay in approval. He stopped communicating with you because the extensive compliance requirements meant JCU as a university is not able to develop the required policy before the deadline of your scholarship application.

It is unfortunate that the timing of the government policy has resulted in your application not being considered at JCU. It is however not the fault of A/Prof. -. Government decisions have major impacts on university operations and the situation is very similar for many other Australian universities.

On behalf of JCU, I thank you for taking the time to make us aware of your situation and wish you best of luck in your future endeavour.

من فكر مي كنم دانشگاهاي استراليا رفتارهاي چند گانه اي دارند و يك سياست مشخص را دنبال نمي كنند

سلام دوستان. من با يه استاد از QUT مكاتبه داشتم. زمينه كاري ام پردازش تصوير و تشخيص هويت. بهم گفت اون تشخيص هويت رو بي خيال شو چون امنيتي و تحريم رو شاخشه. يه پروپوزال داد بهم كه مبحث رياضي صرف هست تو پردازش تصوير. حالا من مي خواستم اپلاي كنم. مقالاتم رو هم بفرستم؟ چون همشون تو زمينه تشخيص هويت بوده. آخه تو CV هم ليست كردمشون. و يه چيز ديگه. اگه تو CV علاقه هام همين تشخيص هويت باشه DFAT گير ميده؟

سلام.
من واقعا این همه نظرات و صفحات رو خوندم شوکه شدم. من از طرف استاد پذیرش گرفتم از دانشگاه سویینبرن. بورسیه هم رفته جلو و منتظر زبان من هستند. تواین مدت 2 ماه هم استاد هیچی نگفته در مورد تحریم و ایرانی بودن و اینا. خیلی هم خوب برخورد کرده و همچنین کاری که من می کنم دقیقا در راستای کارهای ایناست. زمینه کاری من سیستم های برق هوشمند از دیدگاه کامپیوتر هست. این دانشگاه هم خیلی ایرانی داره توش. فردا قراره اسکایپ دارم باهاش. به نظرتون بپرسم که امکان ندادن فاند برای من به خاطر ایرانی بودنم هست یا نه؟

Unless you have citizenship or permanent residency in Australia, Australian sanctions laws implementing United Nations and Australian autonomous sanctions make it very difficult for students from Iran, Syria and North Korea to study in the [name of discipline] discipline. These sanctions are imposed on Monash University by Australian law and mean that, except in limited cases not affected by these laws, you are unlikely to be able to pursue a research degree in this area at Monash University.


The difficulty arises because the Australian sanctions laws list a very large number of goods, equipment, chemicals, materials, organisms, agents, pathogens, processes and technologies that persons from Iran, Syria and North Korea are prohibited from using and accessing while in Australia.


Many of these are commonly used in Monash University laboratories and research, and commonly required for even basic scientific research.


If you wish to pursue your enquiry, I will be required to make a preliminary assessment of your research proposal. In many cases the University is finding proposals do not even pass such a preliminary assessment. If a proposal passes this initial high level review, substantial documentation and approval processes would need to be completed and passed before the University would consider making an offer. This may include seeking advice from the Department of Foreign Affairs and Trade (DFAT), which administers Australian sanctions laws. Experience suggests it can take several months to receive such DFAT advice, in addition to the time spent preparing a formal
enquiry.
Having regard to general advice provided by DFAT about its interpretation of the Australian
sanctions laws as they apply to university research activity, Monash University expects there will

be very few research proposals involving students from Iran, Syria and North Korea in the applied

sciences that can proceed.

To be honest it has now become almost impossible for us to run PhD’s in engineering for Iranian students. Hopefully these sanctions will not last forever.

This means that all research projects have to undergo an additional and thorough review to ensure they do not breach international sanctions. Each application from a student from a sanctioned country will now have to be subject to an additional risk assessment process. This is a time-consuming and complex process which may take quite some months and it is not currently possible to indicate when you may be eligible for a formal letter of offer from the University.

Allowing extra time for processing is particularly important for any student intending to apply for an RMIT scholarship as RMIT will not accept any responsibility for Department of Foreign Affairs and Trade (DFAT) assessment processing that is not complete by the relevant deadline date.
