This (commonly that) being said is an adverbial participle phrase. It should be pointed out that the verbal part, being said, contains a non-finite verb. In fact, It behaves like an adverb with respect to the rest of the sentence. The idiomatic phrase this being said contains no finite verb and no tense.
Wrongly, being is often called the "present participle", but there is nothing to represent the present tense and any tenses about this structure, for instance: The floor was being cleaned last week.
In this case, the underlined part doesn't associate with any tense. It just indicates the progressive and passive form. The tense is merely indicated by the finite verb in BOLD.
