بسیاری از دوستان اخیرا از این طریق برای گرین کارت اقدام کردن یا در حال اقدام هستن. این تاپیک رو ایجاد میکنم که دوستان سوال ها و تجربه های خودشون رو به اشتراک بزارن. اطلاعات کلی رو تو لینک زیر پیدا می کنین. اگر دوستانی اقدام کردن، لطفا کردنشیال های خودشون رو هم بنویسن. از مدیران هم خواهش میکنم که موضوغ رو مهم کنن.

سلام! ممنون از این صفحه ای که ایجاد کردید. من فقط میخواستم بدونم اهمیت تعداد ارجاعات به مقاله ها چقدره. تعداد مقاله ها که حتماً مهمه ولی در مورد تعداد ارجاعات و impact factor ژورنالها هیچ جا چیزی نیومده. میخواستم بدونم چه تعداد کل ارجاعاتی خوب تلقی میشه. چون بیشتر بچه ها در دوره دکترا هستن که مقاله های اونا چاپ میشه و معمولاً زمان زیادی از چاپ اونها نمیگذره تا زمان اپلای برای گرین کارت از این طریق و مقاله ها زمان کمی برای سایت شدن رو دارن. خیلی ممنون میشم اگه جوابی به این سوال من بدین.

تعداد مقالات هم مهمه؟مثلا با توجه به رشته ها فرق داره.اینو چه کار باید کرد؟مثلا یه شیمیست ممکنه در طول دوره ی دکترا بتونه 30تا مقاله بده ولی یه جامعه شناس یا رشته ی کشاورزی نتونه 2 تا مقاله هم چاپ کنه.خب این چی میشه وضعیتش؟

سلام!

چند مثال خیلی خوب دارم!

1. دوستی که 2 مقاله معمولی داشت، و زمینه کاری خاصی نداشت به توصیه وکیل از 6 نفر از اساتید مربوط به فیلدش از دانشگاه خودش و دانشگاهی که post doc میخوند Recommendation Letter گرفت و وکیل با حدود 7000 دلار برای گرین کارت گرفت!

2. دوست دیگه ای مقالاتی (احتمالا کم)داشت که citation نداشتند! ولی با پرداخت پول به توصیه وکیل (فقط پیشنهاد داده بود ارجاعات رو زیاد کن) از طریق یکی از موسسات داخل ایران که پول میگیرن مقاله چاپ می کنند ارجاعات رو بالا برد! با پرداخت هزینه وکیل گرین کارت گرفت!

3. دوستی که مقالات کمی داشت و citation هم تا جایی که دیدم نداشت اصلا به غیر از یکی دوتا که self بود... به راحتی گرفت! دلیل؟ این بود که پروژه اش جراحی روباتیکی بود! و خیلی خیلی راحت وکیل با گرفتن چیزی حدود 5 هزار دلار کارش رو جور کرد! چرا؟! چون این طور قبولونده بودند که زمینه کاری منافع برای مردم آمریکا داشته یا همچین چیزایی!

4. دوست دیگه ای که مورد شماره 1 برام تعریف کرد بوده که مقالات زیادی در رابطه با یک موضوع نه چندان خاص داشته.. 7 8 تا مثلا! ولی تو جاهای خوب! ایشون هم با وکیل به راحتی میگیره!

5. این یکی دیگه فامیله... و کیس مال 6 سال پیشه! از وکیل هم خبری ندارم! ایشون با مقالات متعدد... و citation خیلی زیاد.. به راحی گرفت!!

نکته: وکلی پول مسخره و زیادی برای مشاوره میگیره تو این منظور اما همون موارد 1 2 3 4 رو میگه که چه کلک هایی میشه زد! برای این که هزینه وکیل ندید حتما خودتون از کسایی که گرفتن جویا شید (و اینجا هم بگید تا دیتابیس خوبی بشه) .... ولی برای درخواست Green Card از طریق National Interest Waiver حتما و حتما وکیل کار درست بگیرید که فوق العاده تاثیر داره! رقمش هم همون 5 تا 7 هزار تاست! دقیقش رو هم میپرسم!

دقت کنید:

There are no established rules or statutory standards regarding what is considered as 'National Interest'. USCIS considers each case on an individual basis. The Government has become increasingly strict in its interpretation of what it considers to be in the national interest. Application(s) that would have been approved just five or six years ago are now being denied.

دوباره توجه کنید! موارد 1 2 3 4 مال اواسط 2013 هستند! اون هایی که من باهاشون صحبت کردم همه روی گرفتن وکیل خیلی پا فشاری میکردند! در ضمن یکیشون هم که خیلی فکر میکرد خفنه 2 بار رده شده بود و بار سوم با وکیل گرفت! اگر احتیاج به وکیل گرفتن پیدا کردید حتماً سراغ کسی برید که به قولی این کارست و تعداد کیس رو برنده شده!

National Interest Waiver

Below are some key requirements you must fulfill to demonstrate that your request to waive the job offer requirement and, therefore, the labor certification, is in the "national interest." For each requirement, we have included forms of evidence that you may submit to meet the requirement and other tips to help you prepare your petition. As there is no statutory or regulatory definition of the term “national interest”, USCIS relies on a 1998 Administrative Appeals Office precedent decision setting forth a three-prong test for evaluating requests for a national interest waiver. See Matter of New York State Department of Transportation, 22 I&N Dec. 215 (Comm’r 1998) (“NYSDOT”). These three prongs are outlined below.

Requirement 1 - You must show that you plan on working in the United States in an area of substantial intrinsic merit. Under the first prong of the NYSDOT test, it is important for you to focus on the proposed employment. USCIS will look at your documents to determine whether the importance of your proposed work is readily apparent. Some of the evidence you may submit to demonstrate that you plan on working in the United States in an area of substantial intrinsic merit includes: A letter from you and/or your company describing the work and its importance Articles or other published media discussing your and/or your company’s work and its importance Letters from experts in the field attesting to your work and its importance Testimonial letters should include information about the expert’s own credentials, such as a C.V.

Requirement 2: You must show that the proposed impact of your work is national in scope. While your employment may be limited to a particular geographic area, you must establish a benefit to more than a particular region of the country. Under the second prong of the NYSDOT test, you must demonstrate that the proposed benefit to be provided will be national in scope. USCIS will give due consideration to entrepreneurs who establish that their entrepreneurial enterprise will serve the national interest to a substantially greater degree than the work of others in the same field. Some of the evidence you may submit to demonstrate that the proposed impact of your work is national in scope includes: Published articles or media reports Copies of contracts, agreements, or licenses showing the scope and impact Letters from current and former employers discussing your work and its national importance Letters from experts in the field attesting to your work and its national importance Testimonial letters should include information about the expert’s own credentials, such as a C.V.

Requirement 3: You must show waiving the labor certification requirement would benefit the national interests of the United States. The purpose of the labor certification process is to protect the national interests of the United States by ensuring that the wages and working conditions of U.S. workers employed in the same field would not be adversely affected. Thus, when deciding whether to grant a waiver of the labor certification requirement, USCIS looks at all of the evidence to see whether the national benefits you offer are so great that they outweigh the national interests inherent in the labor certification process. This means that your evidence must show that you serve the national interest to a substantially greater extent than the majority of your colleagues and that you have a degree of influence on your field that distinguishes you from your colleagues. The national interest evaluation is prospective. This means you must show that you have a past record of specific prior achievements that indicate future benefits to the national interests of the United States. Demonstrating that your business enterprise will create jobs for U.S. workers or otherwise enhance the welfare of the United States may qualify you for an NIW. However, you still have to show that the creation of jobs domestically for U.S. workers may serve the national interest to a substantially greater degree than the work of others in the same field. Some of the evidence you may submit to demonstrate that waiving the labor certification requirement would benefit the national interests of the United States includes: Copies of published articles that cite or otherwise recognize your achievements Copies of grants or other funding you received listing the amount and terms of the grants, as well as the principal and co-investigators Documents showing how your work is being implemented by others, for example: Contracts with companies using your or your company’s products Documents showing licensed technology that you and/or your company invented or co-invented, and how that licensed technology is being used by others Patents or licenses awarded to you and/or your company with documents showing how they are being used and why they are significant to your field

National Interest Waiver (NIW)

Overview

A National Interest Waiver (NIW) petition falls into the employment-based immigration, second preference (EB2) category (As known as EB2 NIW). Normally, a permanent job offer and an approved labor certification are pre-requisites to file an employment-based, second preference immigration petition. However, a National Interest Waiver (NIW) petition requests that the labor certification requirement be waived for the sake of the “national interest of the United States;” thus, allowing an applicant to apply for an NIW immigration petition without a labor certification or a job offer from a U.S. employer.
First, in order to be eligible to file an NIW petition, a beneficiary or applicant must have an “advanced degree” or “exceptional ability” in the sciences, arts or business. The beneficiary must also persuasively demonstrate that he/she seeks employment in an area of substantial intrinsic merit to the U.S., that the benefit from the candidate’s proposed activity will be national in scope, and that the requirement of a Labor Certification for the candidate will adversely affect the national interest. Each NIW case is adjudicated on its individual merits, but the burden of proof is always on the applicant or beneficiary to establish that exemption from the labor certification will be in the national interest of the U.S.
For an NIW, even if the beneficiary has no employer, he/she may file an NIW petition on behalf of himself/herself. A U.S. employer may also file an NIW petition on behalf of the beneficiary. Furthermore, the beneficiary can file other immigration petitions under other appropriate categories (such as an EB-1(a) Extraordinary Ability petition) while a National Interest Waiver petition is pending.
Recent Changes and Regulations

After the current economic slowdown and the tightening of U.S. immigration policy, obtaining an approval for NIW petitions is more difficult than ever before. Moreover, the USCIS Texas Service Center and the USCIS Nebraska Service Center, which decide all NIW petitions, may in practice have different approaches and standards. Due to the complexity and high standards involved with an NIW petition, we strongly recommend that you seek assistance from experienced NIW immigration attorneys—the key to your success—especially under the current strict immigration conditions.
Currently, all employment-based, second preference applicants may simultaneously file an I-485 with their I-140 petitions with the exception of individuals born in mainland-China and India. This means that applicants are eligible to adjust their status and obtain green cards faster than through labor certification or all family based categories other than immediate relatives. India and mainland-China born nationals may also obtain NIW I-140 approvals, and will be able to adjust their status when visa numbers become available in the EB-2 category.
NIW applications have clear advantages over other regular employment based immigrant petitions. Since there is no labor certification or permanent job offer requirement, an NIW is an attractive choice for scholars, researchers, post-doctoral research fellows, PhD students, and other advanced degree professionals. Despite factors that generally make it difficult to receive a National Interest Waiver, our approval rate remains very high as a result of our experienced immigration attorneys.
